This checklist provides a general overview of the documents and information that may be helpful when starting a probate application in Ontario.

Not every item will apply. Additional documents may be requested after the circumstances of the estate have been reviewed.

You do not need to have everything listed below before contacting Nobari Law Professional Corporation.

Please begin gathering:

• proof of death, such as a death certificate or funeral director’s statement;
• the proposed estate trustee’s full legal name, address, and contact information;
• the names and contact information of beneficiaries and relevant family members;
• a preliminary list of estate assets and approximate values as of the date of death;
• available bank, investment, mortgage, and property statements;
• details of any real estate owned by the deceased;
• information about jointly owned assets and named beneficiaries, if known; and
• a preliminary list of known debts and estate expenses.

Please also gather:

• the original signed Will and any Affidavit of Execution stored with it;
• any original codicils;
• if no Affidavit of Execution is available, the names and contact information of the witnesses, if known;
• information about any named executor who has died, is unable to act, or does not wish to act.

Keep the original Will and codicils safe. Do not write on them or otherwise alter their condition.

Please also gather:

• information about the steps taken to look for a Will;
• details of the deceased’s spouse, partner, children, and other close family members;
• information about any separation, divorce, or previous marriage;
• the names and contact information of anyone who may have an equal or prior right to apply as estate trustee; and
• details of any beneficiary who is under 18 or may be incapable of managing property.
